What types of buildings are eligible for the Latent Defects Protection?
Single-family homes, multiplexes of two to five units, and condo units (private areas only) that are more than five years old and sold with a legal guarantee are eligible for the Latent Defects Protection. Note that commercial buildings, buildings sold without a legal guarantee, and buildings that are less than five years old are NOT eligible.
Can the Latent Defects Protection be applied after the deed of sale has been notarized?
No. To be valid, the Latent Defects Protection must be applied before the deed of sale is signed, whether you are a buyer or a seller.
Is it possible that an eligible property might be refused by the Latent Defects Protection?
All properties can be protected by the Latent Defects Protection as long as they meet all eligibility criteria. Inspection reports make it possible to identify elements that are not covered by the guarantee, since they’ve been uncovered by an inspector. Once these elements are raised, they’re simply excluded from the guarantee.
